1. Acceptance of Terms
By accessing or using SchnelPay LLC (“SchnelPay,” “we,” “us,” or “our”) services, website, dashboard, or API (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.
We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
2. Description of Service
SchnelPay is a non-custodial cryptocurrency payment platform that enables users to connect wallets, check balances, and facilitate crypto payments across multiple blockchains including Ethereum, Bitcoin, and Solana.
SchnelPay is currently in beta. Features may change, and service availability is not guaranteed. We are not a bank, money transmitter, or financial institution.
3. Cryptocurrency Conversion via Third-Party Providers
SchnelPay provides infrastructure that allows you to access cryptocurrency purchase and cash-out services offered by third-party providers, currently Transak. SchnelPay itself does not buy, sell, exchange, or convert cryptocurrency or fiat currency on your behalf, and does not act as the money transmitter for these transactions.
When you use the conversion feature:
- The purchase or conversion is executed by Transak, a separate company, under Transak’s own terms of service and privacy policy, which apply to that transaction in addition to these Terms.
- Transak is responsible for the processing, settlement, identity verification, compliance, and delivery of funds for the conversion. SchnelPay does not control and is not responsible for Transak’s services, fees, exchange rates, processing times, or decisions (including any decision by Transak to approve, delay, or decline a transaction).
- Any disputes regarding a conversion transaction (e.g. funds not received, incorrect amount, verification issues) are between you and Transak, subject to Transak’s terms and support processes.
You are responsible for ensuring your use of these services complies with the laws of your jurisdiction.
4. Eligibility
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.
The Service is not available to users in jurisdictions where cryptocurrency payments are prohibited by law. You are responsible for compliance with local laws.
5. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your password and authentication credentials
- Notify us immediately of any unauthorized use of your account
- Never share your private keys with SchnelPay or any third party
- Accept responsibility for all transactions initiated from your account
SchnelPay is non-custodial — we never hold, store, or have access to your private keys or crypto assets.
6. Prohibited Activities
You agree not to use the Service for any of the following:
- Money laundering, terrorist financing, or any illegal financial activity
- Violating any applicable law or regulation
- Circumventing sanctions or export control regulations
- Fraud, phishing, or deceptive practices
- Interfering with or disrupting the Service or its infrastructure
- Reverse engineering or attempting to extract source code
- Using the Service on behalf of a sanctioned person or entity
7. Intellectual Property
All content, trademarks, logos, software, APIs, and technology used in the Service — including QuantumShield™ — are owned by SchnelPay LLC and protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works without our written consent.
8. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
Cryptocurrency Risk. Cryptocurrency values are highly volatile. SchnelPay does not provide financial advice. You assume all risk associated with cryptocurrency transactions, including but not limited to price volatility, transaction irreversibility, and regulatory changes.
9. Limitation of Liability
To the maximum extent permitted by law, SchnelPay shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or crypto assets, arising out of or related to your use of the Service.
Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid to SchnelPay in the twelve months preceding the claim.
10. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us at [email protected].
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Alameda County, California.
